Third Party Insurance Coverage Disputes:
Whether involving primary CGL, homeowners or auto insurance policies, or professional, employment, health and disability access and umbrella policies, Carlock Copeland assists insurers in successfully navigating coverage disputes. We carefully evaluate coverage positions, devise cost-effective resolution strategies, through issuance of opinion letters, reservation of rights letters, non-waiver agreements and denial letters, or filing and defending declaratory judgment actions, as well as negotiating resolutions involving complex coverage triggers and allocation issues.
Bad Faith Litigation:
Bad faith or extra-contractual litigation has grown into a specialization within the plaintiff’s bar, and we are prepared for the challenges of this high-stakes litigation. When coverage decisions and third party claims handling result in bad faith litigation, we are uniquely qualified in handling these matters, are sensitive to the nature of such claims, and can promptly devise a resolution strategy, which incorporates an aggressive trial plan.
Carlock Copeland’s insurance coverage practice also encompasses first party property matters arising from property losses of homeowner claims to complex, large property loss claims, caused by natural disasters, explosions, building collapse, machinery, equipment and fixture failure, to fire and theft loss. An integral aspect of this practice area is spearheading investigations involving significant business losses, designed to ascertain and evaluate the conduct of the insured, compliance with the terms and conditions of the policy, and conduct examinations under oath. It is essential to become engaged in the early stages of a first party property loss in order to properly resolve the exposure, but also identify and preserve potential subrogation options, and where necessary, devise effective recovery strategy.
Arson and Fraud:
Arson and fraud claims involve thorough investigation, coupled with the integration of services from other disciplines, including cause and origin experts, forensic accountants, other experts and consultants, as well as federal and state agencies such as the Federal Bureau of Alcohol, Tobacco & Firearms, State Farm Marshall & Insurance Commissioner, and local police and fire departments. We maintain an updated network of contacts within these disciplines in order to promptly initiate and facilitate in-depth investigations, where necessary. Another aspect of this practice is advising insurers of duties related to others with an interest in the insurance proceeds, such as mortgagees and innocent co-insureds.
